The Constitutional Court (CC) has ruled that the Prosecutor General and the Superior Council of Prosecutors (SCP) will appoint the Chief Prosecutor of Gagauzia. The decision followed a referral submitted by Prosecutor General Ion Munteanu.
On January 29, 2025, the official requested the judges to provide their opinion on the Chief Prosecutor’s appointment of Gagauzia. He argued that the involvement of the People’s Assembly in the selection process, as previously outlined by the regulations, violates the principle of separation of powers within the state.

The Constitutional Court determined that the contested provisions conflicted with the Constitution. This disruption undermined the constitutional structure of the judiciary and jeopardized the independence of prosecutors. As a result of this ruling, the Superior Council of Prosecutors and the Prosecutor General will exclusively exercise their constitutional duties regarding the selection and appointment of the Chief Prosecutor of the UTA Gagauzia Prosecutor’s Office, according to a statement from the Prosecutor General’s press service.
