New VAT Regulations for the HORECA Sector During the State of Emergency: How Much Will Businesses Pay

The HORECA sector (hotels, restaurants, cafés) will benefit from a reduced VAT rate throughout the entire period of the energy state of emergency. According to the State Fiscal Service (SFS), starting today, December 16, 2024, and until February 13, 2025, a reduced VAT rate of 6%, down from 8%, will apply.

The law provides for the application of the reduced VAT rate to activities listed under the first section of the National Economic Classifier, including hotels, restaurants, and catering services, explained Aneta Zasavitchi, a public policy expert in the HORECA sector and former president of the National Association of Restaurants and Leisure Establishments.

“According to the provisions of Law No. 76/2021, during a state of emergency and/or a state of public health emergency across the entire country, by derogation from the provisions of Article 96 of the Tax Code, a 6% VAT rate is established. This rate applies to food and/or beverages, except alcoholic products, whether prepared or unprepared, for human consumption, accompanied by related services that allow their immediate consumption, carried out within activities listed under section I of the Classifier of Economic Activities of Moldova. It also applies to accommodation services, regardless of the comfort category, in hotels, apart-hotels, motels, tourist villas, bungalows, guesthouses, agrotourism guesthouses, campsites, holiday villages, or vacation camps, all of which are listed under section I of the Classifier of Economic Activities of Moldova,” the SFS stated in a press release.
