Maintenance Pension in Moldova to Be Reassessed Annually Under New Law

The maintenance pension—including child support—will be updated through a new reevaluation mechanism, as stipulated in the recently promulgated law amending the Family Code, published today in the Official Journal.

Under the new provisions, all court-ordered fixed-amount maintenance pensions will be adjusted annually in line with changes to the national average minimum existential level, calculated and published by the National Bureau of Statistics (BNS).

Importantly, the law sets a minimum threshold: maintenance pensions cannot fall below 50% of the minimum existential level for the respective year.

The court recognizes the ruling establishing the pension amount as an enforceable title. If the debtor fails to make payments as stipulated, the creditor can request enforced execution via the judicial executor in the region where the debtor resides.

According to the BNS, over the past five years, the minimum existential level for children has risen by 46.5%, underscoring the need for a mechanism that ensures maintenance pensions keep pace with real costs.

The law will enter into force one month after publication in the Official Journal of the Republic of Moldova.
