Parliament Draft: Authorities Will Fine Parents Who Leave the Country Without Arranging Custody for Their Children

Parents who leave the country without arranging custody for their children may face penalties, according to IPN. MP Angela Munteanu-Pojoga from the PAS party registered and presented the corresponding draft law in Parliament.

The draft introduces a package of legislative amendments that modify the Family Code, the Criminal Procedure Code, the Civil Procedure Code, and the Law on Preventing and Combating Violence Against Women. The new provisions establish penalties for parents who neglect their responsibilities.

“We clarify the conditions under which a parent loses access to information about their child, and we ensure that all actions protect the child’s best interests. We set a three- to four-month deadline for courts to resolve parental rights disputes. We extend the parental obligation to support children in at-risk situations until they finish their studies, without exceeding the age of 25,” said Angela Munteanu-Pojoga.

Other amendments allow minors to refuse visits with a parent they no longer live with. If a parent acts aggressively, the law blocks them from obtaining visitation rights.

The police will intervene without a warrant when they identify a risk to a child. The authorities will simplify the process for obtaining emigration approval for educational purposes. Local guardianship bodies will step in immediately when they detect danger and the local authorities fail to act.
