The Presidency on Turning the Supreme Security Council into an Executive Body: We Believe the Proposals Are Justified

Representatives of the presidential administration in Chisinau consider the proposals to transform the Supreme Security Council (SSC) from an advisory to an executive body justified. The President’s spokesperson, Igor Zaharov, told Realitatea that security mechanisms must match current circumstances.

He also stated that the President guarantees the country’s sovereignty and independence. Therefore, according to him, the head of state must have the proper tools to exercise these responsibilities.

”In an increasingly complex security context, the state’s mechanisms must reflect reality. The Constitution of the Republic of Moldova designates the President as the guarantor of sovereignty, national independence, unity, and territorial integrity. To fulfill these duties, the President must rely on proper tools and mechanisms, in full compliance with the Constitution. We believe the proposed legislation is justified and remain open to discussions with the parliamentary committee on this draft law,” Zaharov said, commenting on the bill currently under public consultation.

On Wednesday, the Committee for National Security, Defense, and Public Order held consultations on a draft law that proposes amending several acts, including those related to national security. Under the proposed changes, the SSC will become an executive body, its decisions will become binding, and ignoring them will carry criminal penalties.

The proposed regulations also state that ”all public institutions and authorities, as well as the entities mentioned in Article 11, paragraph (4), must comply with its decisions, within the limits of the competencies set by law.”

The explanatory note points out that the current legal framework does not clearly define the Supreme Security Council’s (SSC) responsibilities in coordinating institutions and making decisions in the field of national security during peacetime. It emphasizes that the SSC lacks the powers necessary to support the President of the Republic of Moldova.
