Was Vasiloi’s request a reason to delay the release of the Airport attack file? An article from the law, verified at CC

The service negligence file remains hidden in drawers one year after the attack at Chisinau International Airport, which caused the lives of two people. Rosian Vasiloi’s lawyer has requested the lifting of the exception regarding the unconstitutionality of a text in Article 329 of the Penal Code, which prevents the case from being examined in court yet.

Representatives of the Prosecutor General’s Office informed the Realitatea editorial that the defender contested certain criminal prosecution actions. The magistrates from Chisinau Court, Ciocana office, accepted the lawyer’s request.

The Constitutional Court and the investigating judge will provide a solution that will lead to a decision about the case, per the prosecutors.

“In the investigation framework, initiated based on the reasonable suspicion of committing the offense provided for in Article 329 para. (2) letter a) of the Penal Code (service negligence), the case was initiated with the hearing of witnesses and the presentation of significant documents.

On March 6, 2024, authorities accused the suspect of committing the crime.

We note that by an earlier decision of April 18, 2024, the Constitutional Court declared inadmissible another complaint filed by the defense side in the respective criminal case on raising the exception of unconstitutionality of a provision of the Criminal Procedure Code,” sent at the request of the Realitatea editorial Violina Moraru, the speaker of the Prosecutor General’s Office.

On June 30, 2023, a citizen of Tajikistan opened fire at Chisinau International Airport. Guard Igor Ciofu and border guard Sergei Muntean both passed away, and the attacker passed away shortly afterward in his hospital bed.  Rosian Vasiloi, the chief of Border Police, was severely punished, and Interior Minister Ana Revenco resigned at that time. In September 2023, MIA Secretary Igor Trofimov also resigned. The authorities accused him of being guilty of several violations admitted at Chisinau International Airport, which would have facilitated the attack.

Two superior officers and four superior non-commissioned officers from the border control unit faced harsh reprimands. Other officials comprise the deputy chiefs of the Border Police, the shift head of the border control unit, and the senior operational officer of the dispatcher service.

On November 8, 2023, Vasiloi submitted his resignation request. He resigned following another incident in which a citizen of Azerbaijan managed to escape the airport’s sterile area, and law enforcement in the capital searched him.
