Approved! Foreigners with criminal records can no longer avoid extradition from Moldova

Foreigners with legal issues can no longer avoid extradition or evade criminal responsibility in Moldova. The draft law passed today, July 31, in its second reading.

In this context, the draft law’s authors propose increasing the maximum detention period for extradition from 180 days to 12 months.

Additionally, the Law on Asylum will add a new category for requests that authorities must process quickly. This category will cover requests from individuals facing extradition procedures, which will shorten the review time for their asylum applications.

“The authors also propose changing the deadlines and appeals process for court decisions on challenges against the General Inspectorate for Migration’s rulings. Specifically, individuals can appeal a rejected asylum request through administrative litigation within 5 working days of the decision’s notification, without a preliminary procedure. They can challenge the court’s decision to uphold or overturn the rejection at the Court of Appeal. The decision will be final,” state Parliament representatives.

It is worth noting that the modifications will only affect the deadlines for asylum applications that the General Inspectorate for Migration reviews quickly.
