Lucian Rogac, the lawyer of Vladimir Plahotniuc, has requested the recusal of judges Ana Cucerescu and Olga Bejenari from the panel examining the criminal case of the former leader of the Democratic Party of Moldova.
The defense argues that both magistrates are in a situation of incompatibility.
According to Rogac, Judge Ana Cucerescu issued a conviction in 2021 based on the same factual elements involved in Plahotniuc’s case, specifically concerning the companies Dracard, Caritas Group, and Provolirom. He also noted that the judge later recused herself in a related case, officially acknowledging the incompatibility.
At the same time, Rogac stated that Judge Olga Bejenari had confirmed this situation in the past, as she was part of the panel that validated the earlier recusal. Despite this, both judges are currently participating in examining the case without declaring any incompatibility, the defense claims.
The court is scheduled to deliver its verdict in the case involving Vladimir Plahotniuc on April 22, 2026.
