The right to vote and be elected is a cornerstone of democracy. However, Moldovan law outlines specific exceptions that disqualify certain individuals from running in elections.

The Electoral Code prohibits individuals serving in the military from participating as electoral candidates. This restriction also applies to citizens who a final court decision has barred from holding specific public offices. In such cases, the Ministry of Justice, the National Integrity Authority, or the Ministry of Internal Affairs notifies the Central Electoral Commission accordingly.

Anyone convicted by a final court decision or holding an unexpunged criminal record for an intentional crime cannot register as a candidate.

Candidates must also comply with laws on incompatibilities and conflicts of interest. During the electoral period, the following public officials must suspend their duties:

  • Secretaries General of state institutions
  • Members of the Government
  • District Presidents
  • Mayors
  • Prefects
  • Heads and Deputy Heads of public enterprises

These legal provisions aim to uphold the integrity and fairness of the electoral process. By ensuring that no candidate benefits from the influence of public office, the law seeks to guarantee a level playing field for all.
