In the event that the Constitutional Court declares the Șor Party unconstitutional, one option is for the party’s deputies to operate as independent members. This was stated by Minister of Justice, Veronica Mihailov-Moraru, who mentioned that if the judges of the Court rule the party led by Ilan Șor unconstitutional, the Ministry of Justice will seek its permanent dissolution through legal proceedings.
The Minister of Justice stated that the government has submitted a request to the Constitutional Court to examine the constitutionality of the Șor Party, providing compelling arguments that this political party violates the legislation of the Republic of Moldova. According to the government’s request, the activities of the Șor Party are contrary to the rule of law and jeopardize the country’s sovereignty and integrity.
“This case will be unprecedented for the Republic of Moldova; we have not had such a precedent before. For this case, the Constitutional Court has also sought the opinion of the Venice Commission. From the government’s standpoint, I can say that sufficient arguments have been presented. It is well-known that there have been multiple instances of electoral law violations committed by this party, which have led to sanctions. There have been several cases of illegal financing of the party, and several individuals associated with this party are subject to sanctions imposed by the United States and the United Kingdom. The Anti-Corruption Prosecutor’s Office is investigating several cases related to the illegal financing of the party. Taken together, all these factors, in our view, constitute sufficient arguments, but the ultimate decision rests with the Constitutional Court,” said Veronica Mihailov-Moraru during the “360 Grade” program on Radio Moldova.

According to the Minister of Justice, a decision to outlaw the Șor Party would hold other political parties accountable and compel them to operate within the bounds of the law. Veronica Mihailov-Moraru mentioned that the five deputies from the Șor Party faction in Parliament could potentially become independent members.
“If there is a ruling stating that this party is unconstitutional, the Ministry of Justice will initiate legal proceedings for the liquidation and dissolution of the party, including with the Public Services Agency. What is more interesting is what the Constitutional Court will determine regarding the mandates of the deputies, as they were directly elected by the people. The deputies could remain independent because we cannot deny the fact that these deputies were directly elected by the people, and they could continue to function as independent members. However, this is just one option. If some members of this party wish to join another party, it is their right. No one denies the right of association. The power of example is important. If such a request is upheld, the Court will provide certain assessments that will guide the behavior of political party representatives in the future, encouraging them to adopt healthy principles and respect the law,” explained the Minister of Justice.
