The ANI will not verify Trubca’s assets for the time being, but will issue an “advisory opinion.” What are the procedures?

The National Integrity Authority (ANI) will not immediately investigate the wealth and possible conflicts of interest of former MP Alexandr Trubca. Instead, the institution will first issue an “advisory opinion” following a request submitted regarding his case.

According to a response sent to Realitatea, ANI inspectors will launch an official investigation only if suspicions emerge during the review process. Such a control could be initiated ex officio based on identified irregularities.

A document signed by Angela Nenița, head of ANI’s Legal Assurance Directorate, states that Trubca’s request falls under Article 7(3)(g) of Law No. 132/2016 on the National Integrity Authority and has been assigned for review and the preparation of an advisory opinion.

ANI explained that if the examination reveals possible violations related to asset and personal interest declarations, conflicts of interest, incompatibilities, restrictions, or limitations, the institution may initiate an official integrity control.

Under the law, the preliminary review of a potential notification may take up to one month and ends with a decision either to start an investigation or reject the initiation of a control. If launched, the asset and personal interest verification process may last up to nine months.

The case emerged after Trubca spoke at a press conference about his real estate activities following reports that an investigation targeting him had been launched. Amid the controversy, the lawmaker resigned from Parliament.
