Venice Commission Delegation in Moldova: Discussions on the New Constitutional Court Law

A delegation from the Venice Commission is currently in the Republic of Moldova. According to the Ministry of Justice, the delegation members have scheduled several bilateral discussions following Chisinau authorities’ request for the Commission’s opinion on the draft Law on the Constitutional Court. After meeting with the Minister of Justice, the delegation will hold bilateral meetings with Members of Parliament, representatives of the Constitutional Court, and members of the Superior Council of Magistracy.

“We had the honor of hosting the Venice Commission delegation in the Republic of Moldova today. (…) During the discussions with the ministry’s team, we addressed the new provisions included in the draft law and the necessity and circumstances that led to its development. The delegation members appreciated the quality of the draft law, asked questions about some formulations, and made several proposals to clarify certain provisions,” stated Minister Veronica Mihailov-Moraru.

According to the Ministry of Justice, the new Law drafting on the Constitutional Court is a priority outlined in several policy documents on justice reforms. The initiative aims to merge two existing legal acts—Law No. 317/1994 on the Constitutional Court and the Code of Constitutional Jurisdiction No. 502/1995—into a single legislative framework. This will ensure unified legal provisions, eliminate legislative overlaps, and align with the quality requirements for normative acts, as well as the evolving jurisprudence of the Constitutional Court.
