Venice Commission Endorses Moldova’s Draft Law on the Constitutional Court

The Venice Commission has confirmed that Moldova’s draft law on the Constitutional Court (CC) aligns with international standards, upholds constitutional principles, and follows best practices. The findings were adopted at the 142nd plenary session.

While endorsing the draft, the Commission recommended several refinements, including:

  • Clarifying the regime of disciplinary sanctions for CC judges.
  • Defining procedures for constitutional review of international treaties.
  • Providing details on the appointment and oath-taking process for magistrates.

Moldova’s Commitment to Reform

At the session, Justice Minister Veronica Mihailov-Moraru expressed gratitude for the Commission’s expertise. She also addressed key aspects, such as:

  • Judicial control over international treaties,
  • Implementation of Constitutional Court rulings,
  • Decision-making in cases of tied votes.

Next Steps

The draft law, which aims to merge two existing legal frameworks into a single comprehensive act, was adopted in its first reading in December 2024. Before its final adoption, lawmakers will adjust the draft with the Venice Commission’s recommendations.
